Terms of service

These terms govern the use of Lernie by institutions and by the staff and students they invite. If your institution has signed a separate agreement with us, that agreement takes priority where it differs.

1.Using Lernie

By creating an account, buying a plan or using Lernie you agree to these terms and our privacy policy. If you accept them for an institution, you confirm you have authority to do so.

2.Accounts and access

Institutions decide who gets an account and which role they have, and are responsible for the people they invite.

  • Keep your password private and don't share accounts.
  • Tell your institution or us straight away if you think your account has been misused.
  • Sign-in through Google is available where your institution allows it.

3.Acceptable use

Don't use Lernie to:

  • break or probe the platform's security, or access data you're not authorised to see;
  • cheat in assessments, share exam content without permission or get around the Lernie Lockdown app;
  • harass, threaten or discriminate against anyone;
  • upload unlawful, infringing or harmful content, malware or spam;
  • overload the service, scrape it or resell it without our agreement.

4.Assessments and exam integrity

Institutions can require secure exam settings, including the Lernie Lockdown app and activity monitoring. These tools produce signals for instructors; decisions about academic misconduct are made by the institution under its own policies.

5.Your content

Institutions and their users own the course materials, submissions and messages they create. You give us permission to host, copy, process and display that content only to provide and improve the service for your institution. You're responsible for having the rights to anything you upload.

6.AI features

Lernie AI generates drafts of courses and quiz questions. Drafts can contain mistakes, so instructors must review them before publishing. Don't upload material you don't have the right to use as AI input.

7.Plans, payment and renewal

Paid plans are billed monthly or yearly in advance at the price shown on our pricing page, any active discount, or the price in your order. Prices exclude taxes unless stated.

Plans bought online are charged through our payment providers. If a payment fails or an invoice goes unpaid after notice, we may suspend the institution's access until it's settled. Payments are non-refundable except where the law requires otherwise or we agree in writing.

8.Plan limits

Each plan includes a student limit and set of features. If you go over your limit, we'll contact you to move to the right plan; we won't lock students out of their work without notice.

9.Data protection

We process personal data as described in our privacy policy and act on the institution's instructions for the data inside its Lernie space. A data processing agreement is available on request.

10.Availability and support

We work hard to keep Lernie available around the clock and publish live status on our status page. We sometimes need short maintenance windows and will try to schedule them outside busy teaching times. Unless a separate agreement includes a service level, we don't guarantee uninterrupted availability.

11.Third-party services

Lernie connects to services such as Google sign-in, payment providers and email delivery. Their own terms apply to your use of them, and we're not responsible for services we don't control.

12.Ending the service

Institutions can cancel at the end of any billing period. We may suspend or close accounts that seriously or repeatedly break these terms, giving notice where we reasonably can. Before an institution's data is deleted it will have an opportunity to export it.

13.Disclaimers

Lernie is provided as described in these terms and your order. Apart from that, and to the extent the law allows, we don't make other promises, for example that the service will meet every need or be free of all errors.

14.Liability

To the extent the law allows, neither party is liable for indirect or consequential losses, and our total liability for any claim is limited to the fees the institution paid in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

15.Changes to these terms

We may update these terms as Lernie evolves. We'll tell institutions about important changes in advance, and continuing to use Lernie after they take effect means you accept them.

16.Governing law

The governing law and courts for disputes are those set out in your institution's order or agreement with us. We'll always try to resolve concerns informally first, so please contact us.
